Judge Dismisses Konfrst as Defendant in Fasteners Inc. Suit

A U.S. District Court dismissed Steve Konfrst as a defendant in suit filed by Fasteners Inc.
Attorneys for Fasteners Inc. and Konfrst filed a stipulation stating the plaintiff and defendant have “agreed upon, compromised, and settled” all claims.
Fasteners Inc. earlier had filed a suit against RL Industries Inc., d/b/a Timberline Fasteners Inc., Cindy Wormington, Randall Mills Kemp and RTK Enterprises Inc. f/k/a Kemper Products Inc. and Konfrst.
“Fasteners Inc. and Konfrst hereby stipulate to dismiss with prejudice all claims asserted by Fasteners against Konfrst, with each party to bear its own costs and attorneys’ fees,” according to a stipulation filed with the court on July 2, 2008.
Judge Richard Matsch ordered the complaint “dismissed with prejudice as to defendant Konfrst only, with each party bearing own costs and attorney fees.”
Dismissal with prejudice is defined as when a case is dismissed for good reason and the plaintiff is barred from bringing an action on the same claim.
The original Fasteners Inc. suit alleged that former employees operated a “scheme to cripple” the Colorado-based distributor’s Nebraska branch business.
Kemper Products competed with Fasteners Inc.
RL Industries/Timberline acquired Kemper Products Inc. at the beginning of 2008. Randall Kemp became an RL shareholder and vice president of sales. Kemp and Teresa Kemp formed Kemper Products in 1990.
RL/Timberline owner Russ Doran told FIN “we deny any wrongdoing related to the claims in this complaint.”
According to the original filing, Konfrst had been employed by Fasteners Inc. on and off since 2003 and most recently as a salesman. �2008 FastenerNews.com
