The European Union appealed last month’s World Trade Organization ruling that faulted the 28-nation bloc for conducting an unfair anti-dumping duty investigation of Chinese fasteners, Law360 reports.
“Significant aspects of the panel report cannot be regarded as satisfactory in view of the efforts made by the EU to implement in good faith the [Dispute Settlement Body] recommendations and rulings in this dispute,” a European Union spokesman told Law360.
The appeal is likely to be the final recourse in the case for the EU, which has lost aspects of the case on three separate occasions in five years.
“A WTO dispute settlement panel first faulted the EU’s tariffs on screws and bolts in aDecember 2010 decision that was largely upheld by the WTO Appellate Body the following July.”
In response, Brussels recalibrated its tariffs, prompting a separate investigation that resulted in new duties at reduced rates, which Beijing also successfully protested, Law360 reports.
The EU was faulted for an opaque investigation that put China at a disadvantage and flouted the agreement’s rules concerning transparency in AD proceedings. In addition, the WTO criticized the EU for the way in which it tallied the new duties.
