The U.S. Court of International Trade rejected Nucor Fastener’s request for a full investigation into steel fastener imports from China and Taiwan, American Metal Market reports.
Senior Judge Richard W. Goldberg of the U.S. Court of International Trade conducted a hearing in New York in mid March to review the key issues in the case.
“Nothing new arose that suggested a favorable ruling for Nucor,” importer lead counsel Matthew McGrath of Barnes, Richardson & Colburn, LLP told GlobalFastenerNews.com in April.
The issues were previously remanded to the U.S. International Trade Commission, which ruled again unanimously that there was no reasonable indication of injury.
It’s unclear if Nucor Fastener will appeal the ruling to the U.S. Court of Appeals for the Federal Circuit.
In the past Nucor Fastener attorney Dan Pickard has indicated Nucor Fastener would continue to press its case despite setbacks.
In its antidumping petition, filed in September 2009, Nucor Fastener alleged average dumping margins of 145% for Chinese imports, and 74% for imports from Taiwan.
